Contest Rules
    1. Promoter: The promoter of this contest is NorthWestern Corporation d/b/a NorthWestern Energy.
    2. Eligibility: All active NorthWestern customers over the age of 18 in Montana, South Dakota, or Nebraska are eligible to enter to win the Promotion.   
      Employees Officers, Directors, or agents of NorthWestern Corporation and its affiliates, as well as the Employees, Directors, Officers, or agents of advertising, promotional, or other similar agencies under contract with NorthWestern or its affiliated companies are not eligible to participate in the Promotion. In the event an ineligible contestant enters and wins the Promotion, such result will be deemed invalid and the Promoter shall have the right to immediately re-claim any prizes awarded, or the cash value, as well as to pursue any other available remedy at law or equity. In such an event, the Promoter, may, at its sole discretion, hold a subsequent drawing to award the Prize to an eligible contestant.
    3. Contest Term: Begins on March 31, 2008 and ends at 5:00 p.m. on June 4, 2008. Winners will be announced on June 27, 2008. Winners will be notified telephonically by July 2, 2008. If a winning contestant cannot be notified or declines to accept a prize by July 9, 2008, the Promoter may perform, at its sole discretion, a subsequent drawing to award a Prize to another qualified contestant.
    4. Prizes: All prizes shall be restricted to product make and models selected by NorthWestern Energy. A prize suite for an electric customer shall include: an ENERGY STAR Refrigerator with Dispenser; an ENERGY STAR Clothes Washer; and an Electric Clothes Dryer. The prize suite for a natural gas customer shall include: a Gas Range; an option of either a 50-gallon hot water heater, or a natural gas tankless hot water; and an ENERGY STAR programmable thermostat. Regardless of service type, winners will also receive an on-site home energy audit. If a customer wins that has both electric and natural gas service, they will have the option to choose which appliance suite they want and will automatically receive the ENERGY STAR programmable thermostat. In addition to the appliances described herein, the prize suite shall also include an energy audit, which will consist of an audit team providing the homeowner with a home energy report and on-site installable measures. The installable measures will consist of replacing all high-use incandescent bulbs with ENERGY STAR compact fluorescent light bulbs (CFLs); wrap hot water heater if applicable; install foam gaskets on exterior walls where applicable; kitchen and bathroom faucet aerators; low-flow showerhead(s); leave behind can of insulation foam, and window kit; door sweep(s); and weather stripping. A total of three Prize Suites shall be awarded. A Prize suite will be awarded to a NorthWestern Customer in Montana, South Dakota, and Nebraska.
    5. Warranties Expressly Excluded: Promoter makes no warranty as to the performance, operation, or quality of the Prize Suite, or any individual component there of, or any installation. Further Promoter expressly excludes all warranties, except those provided by the manufacture, including but not limited to, warranty of merchantability and fitness for a particular purpose.
    6. Limitation of Liability: Neither the Promoter (including its affiliates) nor its Officers, Directors, agents, employees, subcontractors, sponsors, or assigns shall be liable for any direct or indirect loss, injury or damage, including personal injury or death, arising from any entrant’s participation in the contest, nor for the prize winners in their fulfillment of the prize howsoever arising. In no event shall Promoter be liable for any indirect, consequential, incidental, special, exemplary, or punitive damages arising from or related to this Promotion or its performance, such as, but not limited to loss of revenue, anticipated profits, or business. In the event of damages arising from or related to this Agreement, its performance, enforcement, breach or termination, such as, but not limited to loss of revenue, anticipated profits, or business.
    7. Installation: NorthWestern is not responsible, nor does it warrant the sufficiency or quality of, appliance installation. NorthWestern will arrange for free delivery of the Prize Suite to the winner, but all costs associated with installation are at the homeowners’ expense.
    8. Termination of Contest: 9. If required to do so, because of legislative, judicial, regulatory, or other governmental action or regulatory obligation, the Promotion may be terminated immediately and without notice. In the event of such termination, all participants acknowledge that by entering this contest they have agreed to waive any rights or cause of action they have arising out of the termination and acknowledge they will have no recourse against the Promoter its affiliates, agents, employees, officers, directors, subcontractors, successors, or assigns.
    9. Dispute Resolution: In the event of any dispute, the decision of NorthWestern is final and binding.
    10. Acknowledgement: All participants by entering this contest acknowledge that they have read the rules and agree to be bound by their terms.
    11. Right to Publish: The prize winners by accepting the prize assign all rights to the Promoter to publish their names and photographs in any promotion, print, point of sale or public relations material. The prize winners by accepting the Prize Suite agree to appear and be identified, in or on national and regional media at no fee.
